1. Acceptance of These Terms

These Website Terms of Use (“Terms”) govern your access to and use of the websites, digital publications, community platforms, forums, directories, online portals, newsletters, applications, and other digital properties owned or operated by Crystal Vision Media Network that link to these Terms.

2. About Crystal Vision Media Network

Crystal Vision Media Network owns and operates a network of local-area media publications and related digital properties.

These Properties may provide editorial reporting, relocation information, community resources, market research, neighborhood information, business profiles, directories, guides, event information, interviews, sponsored content, educational materials, forums, and other services intended to inform and connect the communities we serve.

These Terms apply to all current and future Crystal Vision Media Network Properties that display or link to them.

References in these Terms to “Crystal Vision Media Network,” “we,” “us,” or “our” mean Crystal Vision Media Network and the people and service providers authorized to operate the applicable Property on its behalf.

3. Changes to These Terms

We may revise these Terms periodically to reflect changes in our Properties, business practices, technology, services, or legal obligations.

The “Last Updated” date at the beginning of these Terms identifies the most recent revision. Updated Terms become effective when posted unless a different effective date is stated.

10. Use the Properties to distribute spam, unauthorized advertising, solicitations, chain messages, or unlawful promotional material.
11. Interfere with the operation, security, integrity, or availability of any Property.
12. Encourage, assist, or enable another person to engage in prohibited conduct.

We may investigate suspected violations and restrict or terminate access when we reasonably believe that a user has violated these Terms, additional community rules, or applicable law.

5. Editorial Purpose and Independence

Crystal Vision Media Network maintains separation between editorial judgment and commercial participation.

A business, professional, contributor, advertiser, sponsor, or community member does not obtain control over our editorial decisions merely because that person or organization:

• purchases a product or service;
• advertises or sponsors content;
• participates in an interview;
• submits information;
• provides a quotation;
• serves as a contributor or local expert;
• receives a business profile;
• participates in a promotional program; or
• maintains another commercial relationship with us.

We retain editorial control over selection, presentation, context, headlines, editing, publication, correction, updating, placement, and removal of content.

Paid, sponsored, promotional, contributed, and independently produced editorial content may be identified or treated differently in accordance with our Editorial Standards and applicable law.

By submitting a User Submission for display, publication, editorial consideration, community participation, or promotion, you represent and warrant that:

1. You own the submission or have all permissions necessary to provide it.
2. The submission does not infringe another person’s copyright, trademark, privacy, publicity, contractual, or other rights.
3. The submission is not knowingly false, deceptive, defamatory, unlawful, threatening, or malicious.
4. Any person identifiable in the submission has provided any permission required for the intended use.
5. The submission complies with these Terms and any applicable additional rules.

Unless a separate written agreement provides otherwise, you grant Crystal Vision Media Network a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, edit, adapt, publish, display, distribute, excerpt, and promote the User Submission in connection with the Properties, our publications, our editorial work, and the promotion of the content in which the submission appears.

This license allows us to operate and promote our publications. It does not transfer ownership of your original work to us.

User Submissions involving interviews, professional content, commissioned materials, client materials, photographs, recordings, testimonials, or broader promotional rights may also be governed by a separate media release, content license, submission agreement, promotional-use agreement, or client agreement.

16. Public Forums and Community Areas

Certain Properties may include publicly accessible forums, comments, questions, profiles, or other community features.

Information intentionally posted in a public area may be viewed, copied, quoted, shared, or indexed by other people, search engines, archival services, and AI-enabled search or discovery services.

Do not post private, confidential, sensitive, or personally identifying information that you do not want made public.

Community participation may also be governed by separate Community Guidelines or Forum Terms. We may moderate, edit, label, move, restrict, close, or remove community content and accounts in accordance with those rules.

We are not obligated to publish every submission or preserve a submission indefinitely. Removal from a live Property may not remove copies previously cached, indexed, captured, quoted, downloaded, or shared by third parties.

17. Private Business Portals

A Crystal Vision Media Network Business Portal may contain private materials, client communications, drafts, deliverables, agreements, downloads, or account information.

Access to a Business Portal is limited to authorized users. Portal access does not authorize a user to share, publish, distribute, or provide portal materials to another person unless the applicable agreement expressly permits it.

Portal services, deliverables, payments, intellectual-property rights, confidentiality obligations, and client relationships may be governed by a separate written agreement. The applicable client or service agreement will control if it conflicts with these general Terms.

18. Feedback and Suggestions

If you voluntarily provide an idea, suggestion, correction, recommendation, or other feedback about our Properties or services, you authorize us to consider and use that feedback without compensation or an obligation to adopt it.

This section does not transfer ownership of separately submitted creative work, commissioned content, or materials governed by another written agreement.

19. Copyright Concerns

We respect intellectual-property rights.

If you believe content on a Crystal Vision Media Network Property infringes your copyright, please send a written notice containing:

1. Identification of the copyrighted work.
2. Identification and location of the material you believe is infringing.
3. Your name and contact information.
4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.
6. Your physical or electronic signature.

Submitting a knowingly false copyright claim may have legal consequences.

20. Third-Party Websites, Services, and Embedded Content

The Properties may link to or display content, maps, videos, social media, advertisements, ticketing services, payment services, business websites, government resources, or other services operated by third parties.

A link, embed, mention, or listing does not necessarily constitute an endorsement.

Third-party services operate under their own terms, privacy policies, availability, and security practices. Crystal Vision Media Network does not control and is not responsible for third-party content, products, services, transactions, policies, security, or conduct.

You access and use third-party services at your own discretion.

21. Advertising, Sponsorships, and Affiliate Relationships

The Properties may contain advertisements, sponsored content, paid business profiles, promotional placements, affiliate links, or other commercial relationships.

We may receive compensation, products, services, commissions, or other value in connection with certain content or links. When disclosure is required, we will make reasonable efforts to identify the relevant commercial relationship.

The presence of advertising, sponsorship, affiliate compensation, or another commercial relationship does not constitute a guarantee of the advertiser’s or third party’s products, services, claims, or performance.

Users are responsible for evaluating products, services, businesses, and offers before entering into a transaction.

22. Purchases and Paid Services

Certain Properties may offer paid products, subscriptions, advertising, sponsorships, profiles, content services, promotional packages, portal access, or other services.

Prices, deliverables, payment schedules, renewal terms, cancellation rights, refund terms, and license rights may be described at the point of purchase or in a separate agreement.

These general Terms do not create a right to a refund, renewal, continued placement, particular audience result, or commercial outcome. The applicable order, proposal, invoice, service agreement, or purchase terms will govern the transaction.

You agree to provide accurate billing information and to pay authorized charges according to the applicable agreement.

Payment processing may be performed by a third-party processor. We do not necessarily receive or store complete payment-card information.

23. Privacy

Our collection, use, disclosure, retention, and protection of personal information is described in the Crystal Vision Media Network Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference. By using the Properties, you acknowledge that you have been provided access to the Privacy Policy.

Public submissions and private account information are treated differently. Before posting information to a forum, comment area, public profile, or other public feature, consider whether you want that information to become publicly available.

24. Availability, Security, and Changes to the Properties

We may add, change, suspend, restrict, or discontinue any Property, feature, service, content category, account type, or publication at any time.

We do not guarantee that:

CRYSTAL VISION MEDIA NETWORK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

WE DO NOT WARRANT THAT THE PROPERTIES WILL MEET EVERY USER’S REQUIREMENTS; THAT ACCESS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT ALL CONTENT WILL BE COMPLETE, CURRENT, OR ACCURATE; OR THAT USE OF THE PROPERTIES WILL PRODUCE A PARTICULAR PERSONAL, EDITORIAL, COMMERCIAL, FINANCIAL, OR OTHER RESULT.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, these exclusions apply only to the extent permitted by law.

26. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CRYSTAL VISION MEDIA NETWORK AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRIBUTORS, CONTRACTORS, REPRESENTATIVES, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO:

• ACCESS TO OR USE OF A PROPERTY;
• INABILITY TO ACCESS OR USE A PROPERTY;
• RELIANCE ON CONTENT;
• ERRORS, OMISSIONS, INTERRUPTIONS, OR DELAYS;
• THIRD-PARTY CONTENT, SERVICES, PRODUCTS, OR CONDUCT;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF INFORMATION;
• LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY; OR
• ANY OTHER MATTER RELATING TO THE PROPERTIES.

This limitation applies regardless of the legal theory asserted and even if the possibility of such damages was known or reasonably foreseeable.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

27. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Crystal Vision Media Network and its owners, officers, employees, representatives, contractors, contributors, service providers, and affiliates from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising out of or related to:

1. Your material violation of these Terms.
2. Your unlawful or unauthorized use of a Property.
3. Your User Submissions.
4. Your violation of another person’s intellectual-property, privacy, publicity, contractual, or other legal rights.
5. Your fraudulent, deceptive, defamatory, malicious, or unlawful conduct.
6. A transaction, promise, representation, product, or service you offer to another user through or in connection with a Property.

We reserve the right to control the defense of a matter subject to indemnification. You agree to provide reasonable cooperation in that defense.

This provision does not require a consumer to indemnify us for conduct for which indemnification cannot lawfully be required.

28. Suspension and Termination

We may suspend, restrict, or terminate access to a Property or account if we reasonably believe that:

• these Terms or another applicable agreement have been violated;
• an account presents a security or legal risk;
• a user has abused another person or the community;
• access is unauthorized;
• payment obligations have not been met;
• continued access may harm a Property, user, third party, or Crystal Vision Media Network; or
• suspension or termination is required by law.

Termination does not eliminate obligations or rights that arose before termination. Provisions that logically should continue—including intellectual-property rights, licenses, disclaimers, liability limitations, indemnification, and dispute provisions—will survive.

29. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any legal proceeding arising out of or relating to these Terms or the Properties must be brought in a state or federal court having jurisdiction over the area in which Crystal Vision Media Network maintains its principal business address.

Nothing in this section prevents either party from seeking relief in another forum when applicable consumer law or another controlling law requires it.

30. Notices

We may provide notices by posting them on a Property, sending them to the email address associated with an account, displaying them during use of a service, or using another reasonable method.

31. Severability

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed to the minimum extent necessary.

The remaining provisions will remain in effect.

32. No Waiver

Our failure to enforce a provision of these Terms does not waive that provision or our right to enforce it later.

A waiver is effective only when made expressly in writing by an authorized representative of Crystal Vision Media Network.

33. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a restructuring, merger, acquisition, sale, transfer of assets, change in ownership, or operation of the Properties by a successor or affiliated entity, subject to applicable law.

34. Entire Agreement

These Website Terms of Use, together with the Privacy Policy and any additional terms expressly applicable to a particular feature, submission, transaction, account, community, or service, constitute the entire agreement between you and Crystal Vision Media Network concerning your use of the Properties.

They supersede prior or contemporaneous understandings concerning general use of the Properties.

A separately executed client, contributor, media, advertising, sponsorship, portal, purchase, or service agreement remains independently enforceable and controls the subject matter addressed in that agreement.
